Today he finish transcribing the comments on Canon 1095 made by the Canon Law Society of America (CLSA). We remind our readers that the purpose of this series of three posts is to provide an example of how liberal the marriage annulment criteria became, based either on the text of the new Code of Canon Law or the American interpretation of it. We do so at the request of Fr. Paul Sretenovic to illustrate his analysis of the causes for annulments of Catholic marriages.
In the two last documents, we saw the commentaries on the lack of the use of reason for consent, and lack of discretion of judgment. Today, we finish the commentaries on the third paragraph of the Canon, referring to the inability to assume the obligations of marriage.
Below, the cover of the New Commentary on the Code of Canon Law (Canon Law Society of America, New York: Paulist Press, 2000) followed by the photocopies of the text of Canon 1095 and the CLSA commentaries of its third paragraph.
